THE SAXON MIRROR AND MAGDEBURG LAW AS THE FOUNDATION FOR EUROPE – EXHIBITION ORGANIZED BY THE FEDERAL STATE OF SAXONY-ANHALT IN KRAKOW
The Saxon Mirror (Sachsenspiegel) and Magdeburg Law are two legal sources which originated in the 13th cent. in the land whose formal name today is the Federal State of Saxony-Anhalt. Due to the excellence of the legal regulations they contained and the common acceptance they had won, these two legal codes became extremely signifi cant, both in terms of the duration of their application, and in terms of their territorial range. Some of the regulations they introduced stayed in use until the 19th cent., and their geographical scope spanned from the Elbe (Magdeburg) to the Dnieper (Kyiv). Legal regulations offered by the Saxon- Magdeburg Law were adopted by hundreds of lands, cities and towns scattered around the vast area encompassing today’s Poland, the Czech Republic, Slovakia, Hungary, Belarus, Estonia, Lithuania, Latvia and Ukraine. The processes of reception which started in the 13th and lasted until the 19th cent. constituted a valuable cultural-historical foundation for modern Europe. This law, originally created in the land located on the banks of the Elbe and the Saale Rivers, functioned throughout the late Middle Ages and the early Modern Era as the binding legal order for merchants, craftsmen, burghers and the rural folk, as well as their landlords throughout the vast reaches of East-Central Europe, including the City of Magdeburg – today, the capital of the Federal State of Saxony-Anhalt – and the neighbouring territories. The Saxon Mirror is the most important German legal code of the Middle Ages. Eike von Repgow compiled the code in the period 1220 to1235, while staying in the foreland of the Harz Mountains. The code was written in Middle Low German. Thanks to the faithful refl ection of the reality, the clear structure and the comprehensible language, it enjoyed exceptional respect in Germany and elsewhere. The famous town law of Magdeburg started to evolve in the 12th cent. in the trade metropolis situated in the middle reaches of the River Elbe. Its regulations concerning the power of local rulers and the rights of the townspeople influenced the development of trade and boosted the turnover of various goods in Magdeburg’s “filial cities” (formally established under Magdeburg Law) which, in turn, brought them great advantages. The “filial cities” received Magdeburg Law through the granting of privileges performed by their local rulers, which is how the thick network of the largest family of town laws in East-Central Europe was born. Legal experts from the Magdeburg City Bench replied to thousands of requests filed by the people of the towns, cities and villages from the lands infl uenced by the Saxon-Magdeburg Law who sought justice and needed their professional assistance. The Saxon Mirror and Magdeburg Law created an incredibly fertile synthesis on the way to united Europe which reverberated through the evolution of European law until the great codifi cation of civil law in the 19th and the 20th cent.. Fundamental concepts of The Saxon Mirror still have their counterparts in modern legal regulations. Responsibility before God and the people while passing sentences, rejection of unjust exercise of power, observance of laws and regulations, and coexistence of various groups and cultures in an atmosphere of tolerance were also among Eike von Repgow’s ideas which he helped to put into practice in his brilliant code. However, the expansion of the law which had originated in the Elbe and Saale region would not have been so successful, had it not been for the locally adjusted and updated variants of the code created in various cities and towns of the Kingdom of Poland and the Grand Duchy of Lithuania. Among the most signifi cant local editions of The Saxon Mirror we should mention those created in Kraków, Wrocław/Breslau, Toruń/Thorn and Chełmno/Kuln, as well as the later academic editions created by eminent Polish scholars of European renown, such as the 16th-cent. scholar Bartłomiej Groicki. By organizing the exhibition, the Federal State of Saxony- Anhalt wanted to draw public attention to this unique phenomenon in the history of German and European law and to encourage visitors to a deeper reflection upon the common foundation of our peaceful coexistence on the European continent. In Kraków this project proved to be extremely successful thanks to the great jubilee exhibition organized in 2007 titled Kraków – the European City of Magdeburg Law 1257–1791. This old, respectable Polish royal city, the seat of an archbishopric and an academic hub truly is a perfect place for this kind of cultural exchanges. It is one of the most signifi cant cities formally established under Magdeburg-Breslau Law in 1257. King Casimir the Great reinforced the privileged position of Kraków by establishing the Higher Court of German Law at Wawel Castle in 1356 which functioned as an appellation court for the towns of the Małopolska region that used German law. And thus, Kraków joined other major centres from which Magdeburg Law radiated and in which it was constantly updated. The very fact that we still remember about it over half a millennium later speaks volumes for its significance.

15. Gugel był rodzajem kaptura z ostrą krawędzią, powszechnie noszono go w Niemczech.
